Subject: INVESTIGATION OWNER AND TRAINER DEON FACEY POSITIVE FINDING - HORSE, WISE JOHNNY ON 18th NOVEMBER, 2017

The First Instance Tribunal, delegatees of the Jamaica Racing Commission, on the
17th June, 2019 concluded an investigation under Section 25 of the
Jamaica Racing Commission Act, into a Report by the Racing Chemist that a urine
sample taken from the horse, WISE JOHNNY on the 18st November, 2017,
indicated the presence of DICLOFENAC AND NIKETHAMIDE, prohibited
substances under the Rules of Racing. The split sample were subsequently
analysed at the Chemistry Department of the University of the West Indies in the
presence of the Referee Chemist, where it was confirmed that DICLOFENAC
AND NIKETHAMIDE were present in the sample.
During the investigation the Tribunal heard evidence on behalf of the Commission, as well as evidence from Owner and Trainer, Deon Facey.
After considering the evidence, the Tribunal:
? Accepted the finding of the Racing Chemist, that the urine samples taken from the horse Wise Johnny, contained the prohibited substances DICLOFENAC AND NIKETHAMIDE and pursuant to Rule 207 of the Racing Rules, disqualified the horse from the race in question.
? Found Owner and Trainer, Deon Facey negligent, hence, he was fined Seventy Five Thousand Dollars ($75,000.00) for the drug Diclofenac and Two Hundred and Fifty Thousand Dollars ($250,000.00) for the drug Nikethamide. The fines are to be paid within a three - month period, which will be on or before 17th September, 2019.
? Owner and Trainer Deon Facey was also warned off from all premises where the rules of Racing are in force, for a period of three (3) years, effective 21st June, 2019.
