Subject: POSITIVE FINDING OF KETEROLAC RETURNED BY HORSE BLUE VINYL

The First Instance Tribunal, Delegatees of the Jamaica Racing Commission, on 11th November 2024 concluded an investigation under Section 25 of the Jamaica Racing Commission Act, into a report by the Racing Chemist that urine sample taken from the horse, BLUE VINYL, following the running of the seventh race on Saturday, 23rd April, 2022, indicated the presence of KETEROLAC, which is in breach of Rule 257 under the Rules of Racing. The split portion (B sample) was subsequently analyzed at the University of the West Indies Mona Analytical Chemistry Lab (UWIMAC), where the presence of KETEROLAC was confirmed to be in the sample taken from the horse. After thoroughly considering the evidence presented by Mr. Garth McBean K.C., the Commission’s Legal Adviser and Mr. Douglas Thompson, attorney-At-Law who represented Trainer Patrick Lynch, the Tribunal: • Accepted the finding of the Racing Chemist, that the urine samples taken from the horse on Saturday, 23rd April, 2022, contained the drug KETEROLAC (Class 3 prohibited substance). • Ruled that Trainer Patrick Lynch was liable for the prohibited substance found in BLUE VINYL. • Imposed a fine in the amount of Seventy-five Thousand Dollars ($75,000.00) on Trainer Patrick Lynch, to be paid within 30 days after the ruling. • Disqualified BLUE VINYL from the race, pursuant to Rule 207 of the Racing Rules 1977. Mr. Garth McBean K.C., the Commission’s Legal Adviser, marshalled the evidence on behalf
