Subject: WINSTON HERBERT BROWN (GROOM) WARNED OFF IN 1992 AND 1993 UNTIL HE APPEARED BEFORE THE FIRST INSTANCE TRIBUNAL

Mr. Winston Brown, who was the Groom of ISLE OF PATMOS AND CARNIVAL QUEEN, in 1992 and 1993 failed to attend Investigations pursuant to section 25 of the Jamaica Racing Commission Act in relation to positive findings returned by the said horse and pursuant to Rule 247 he was warned off from all courses and other places where the Rules of Racing are in force until he appears before the Tribunal. On 29th July, 2019, he eventually appeared before the First instance Tribunal and during the investigation, evidence was heard from Mr. Winston Brown that he did not receive summonses to attend the investigations in 1992 and 1993, and had no knowledge that investigations were being held. After considering the evidence; the Tribunal: • Concluded that the evidence is not conclusive in relation to Mr. Winston Brown being aware that he ought to have come before the Tribunal, over twenty years ago. • The Tribunal also considered the fact that correspondences were being sent to an address which Mr. Brown had no longer resided, after migrating to St. Elizabeth to look after his mother who had fallen ill. • In the circumstances, the Tribunal, found no evidence to make Mr. Brown culpable and, hence he was discharged and the warning off was lifted.
