Subject: INVESTIGATION - POSITIVE FINDING RETURNED BY HORSE CRAFTY STAR ON 24TH NOVEMBER, 2018 – PROHIBITED SUBSTANCES: LIDOCAINE & DICLOFENAC

The First Instance Tribunal, delegatees of the Jamaica Racing Commission, on the 9TH SEPTEMBER, 2019, concluded an investigation under Section 25 of the Jamaica Racing Commission Act, into a report by the Racing Chemist that a urine sample taken from the horse, CRAFTY STAR, on the 24th NOVEMBER, 2018 indicated the presence of LIDOCAINE & DICLOFENAC, prohibited substances under the Rules of Racing. The split sample was subsequently analysed at the University of the West Indies Mona Analytical Chemistry Lab (UWIMAC) in the presence of the Referee Chemist, where it was confirmed that DICLOFENAC & LIDOCAINE were present in the sample. During the investigation the Tribunal heard evidence on behalf of the Commission, as well as evidence from Trainer, PAUL ANTHONY HYLTON and Groom MARK ANTHONY COLLINS. After considering the evidence, the Tribunal: ? Accepted the finding of the Racing Chemist, that the urine sample taken from the horse CRAFTY STAR, contained the prohibited substances DICLOFENAC & LIDOCAINE and pursuant to Rule 207 of the Racing Rules, disqualified it from the race in question; ? Found Trainer Paul Anthony Hylton negligent after he admitted giving the substances to the groom to administer, hence he was fined Two Hundred Thousand Dollars ($200,000.00) for the LIDOCAINE (Class 2 drug) and One Hundred Thousand Dollars ($100,000.00) for the DICLOFENAC (Class 4 drug). • Trainer Paul Anthony Hylton was also warned off all premises where the rules of Racing are in force, for a period of Six months for the class 2 drug, to be effective, Monday, 16th September, 2019. ? Found Groom Mark Anthony Collins not culpable and discharged him. Mr. Garth McBean Q.C., the Commission’s Legal Adviser, marshalled the evidence on behalf of the Commission.
